Privacy Policy


 1. The Information We Collect
  At some Global Spectrum (GS) sites, you can order products, enter contests, vote in polls or otherwise express an opinion, subscribe to one of our services such as our online newsletters, or participate in one of our online forums or communities. The types of personally identifiable information that may be collected at these pages include: name, address, e-mail address, telephone number, fax number, credit card information, and information about your interests in and use of various products, programs and services.
  We also may collect certain non-personally identifiable information when you visit many of our web pages such as the type of browser you are using (e.g., Netscape, Internet Explorer), the type of operating system you are using (e.g., Windows ’95 or MAC OS) and the domain name of your Internet service provider (e.g., America online, Earthlink).

  GS sites sometimes may offer contests, sweepstakes or promotions that are sponsored by or co-sponsored with identified third parties. By virtue of their sponsorship, these third parties may obtain personally identifiable information that visitors voluntarily submit to participate in the contest, sweepstakes or promotion. GS has no control over the third-party sponsors’ use of this information. The GS site will notify you at the time of requesting personally identifiable information if third-party sponsors will obtain such information.

5. Cookies
  Cookies are pieces of electronic information that a website can transfer to a visitor’s hard drive to help tailor and keep records of his or her visit to the site. Cookies allow website operators to better customize visits to the site to the visitor’s individual preferences. The use of cookies is standard on the Internet and many major websites use them. Although most web browsers automatically accept cookies, you can usually change your browser to prevent or notify you whenever you are sent a cookie. This gives you the chance to decide whether or not to accept it. Event without accepting a cookie, you can still access most the features on GS sites.
Cookies are not programs that come onto a user's system and damage files. Generally, cookies work by assigning a unique number to the user that has no meaning outside the assigning site. Users should be aware that Global Spectrum cannot or does not control the use of cookies or the resulting information by advertisers or third parties hosting data for Global Spectrum. If a user does not want information collected through the use of cookies, there is a simple procedure in most browsers that allows the user to deny or accept the cookie feature; however, users should note that cookies may be necessary to provide the user with certain features (e.g., customized delivery of information) available on the web site.

6. Opting-Out
  After gathering any user information, GS offers users the opportunity to remove their information from our active database so as not to receive future communications and/or to no longer interact with the website until they later choose to visit the “members” section of the site and amend the instructions they have previously provided. GS additionally provides users the opportunity to update and modify any information they have previously provided by visiting the “members” section of and updating and/or modifying the information previously provided.

7. Security
  We have put in place appropriate physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information we collect online.
  Although we take appropriate measures to safeguard against unauthorized disclosures of information, we cannot assure you that personally identifiable information that we collect will never be disclosed in a manner that is inconsistent with this privacy notice. Inadvertent disclosures may result, for example, when third parties misrepresent their identities in asking the site for access to personally identifiable information about themselves for purposes of correcting possible factual errors in the data.

8. Children’s Privacy Policy
  Currently, GS does not accept information from children under the age of 13. When a child under the age of 13 attempts to submit his or her registration information, GS’s system will reject the submission.
  GS is presently working on implementing procedures to effectuate the requisite notice to parents in accordance with the Children's Online Privacy Protection Act (COPPA).

9. Your Acceptance of These Terms
  By using our website(s), you consent to the collection and use of this information by GS. If we decide to change our privacy policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it.

11. Website Ownership
  The website is owned by Global Spectrum, L.P. (“GS”) and the Arizona Sports and Tourism Authority, LLC (“AZSTA”).  All materials contained in the Website (the “Materials”) are either owned by or licensed to GS and/or AZSTA.  GS, AZSTA and its licensors retain all proprietary rights to the Materials.  Except for downloading one copy of the Materials on any single computer for your personal, non-commercial home use, you may not reproduce, prepare derivative works based upon, distribute, perform or display the Materials without first obtaining the written permission of GS and the AZSTA.

12. Changes to Website
  GS and/or AZSTA may change, suspend or discontinue any aspect of the Website at any time, including the availability of any Website feature, database or content.  GS and/or PAM also may impose limits on certain features and services or restrict your access to parts of or the entire Website without notice or liability.

13. Linking
  The Web site may contain links and pointers to other related World Wide Web sites, resources and sponsors of the Website.  Links to and from the Websites to other Web sites, maintained by third parties, do not constitute an endorsement by GS or AZSTA or any affiliate of any third party Web site or content.  GS and AZSTA are not responsible for the availability of these third party resources or their contents.  You should direct any concerns regarding any external link to its Web site administrator or Webmaster.

14. Indemnification
  You hereby agree to indemnify and hold GS, AZSTA and each of their respective affiliates, successors, assigns, directors, officers, employees, agents and representatives harmless from all claims, liabilities, damages and expenses (including attorneys’ fees and expenses and court costs) arising out of or relating to: (A) your use of any Web site, including, but not limited to use of any Message Feature; and (B) any alleged breach of this Agreement.

15. Termination
  This Agreement and your license to use the Website may be immediately terminated at any time by GS or AZSTA in its sole discretion.
In addition and without prejudice to any other legal or equitable remedies available to GS or AZSTA, GS and/or AZSTA may immediately terminate this Agreement and your license to use the Website if you breach any term of this Agreement or other operating term set forth by GS and/or AZSTA.

16. Notice
  GS and AZSTA may give notice to you by means of a general notice on the Website, or by electronic mail to your e-mail address on record in GS and AZSTA account information.  You may give notice to GS and AZSTA by any of the following means (and such notice shall be deemed given when received by GS and AZSTA at any time):

17. Misc.
  Global Spectrum reserves the right to perform statistical analyses of user behavior and characteristics in order to measure interest in and use of the various areas of the site and to inform advertisers of such information as well as the number of users that have been exposed to or clicked on their advertising banners. Global Spectrum will provide only aggregated data from these analyses to third parties. Also, users should be aware that Global Spectrum may sometimes permit third parties to offer subscription and/or registration-based services through Global Spectrum site. Global Spectrum is not responsible for any actions or policies of such third parties and users should check the applicable privacy policy of such party when providing personally identifiable information.

18. Acceptance of Terms of Use and Privacy Policy
  By using the Website, you signify your agreement to the terms of this Agreement.  If you do not agree to the terms in this Agreement, you must not use the Website.  GS and/or PAM may change the terms of this Agreement at any time upon posting, with or without notice, on the Website, and your use of the Website after such changes are posted will mean that you accept them.
